Mobile Device Agreement
In this contract your organization furnishes its employees with a mobile phone including a subscription. Employees are informed about the conditions attached to the use of the phone. They must use the device in a proper manner and return it on termination of the employment.
From a legal point of view this is a loan for use agreement (in Dutch: bruikleen). The ownership of the device rests with the organization. Employees only have the right to use.
What to fill in yourself
You will receive two documents. The first is an application form for the employees’ personal details. The second document is the actual user agreement mobile phone that must be signed by both parties.

Context
This document can be used in the following situation:
Both the device and the subscription are in name of the employer. A user agreement mobile phone is an employee benefit as part of an employment contract.
It’s possible to provide a telephone without involving the work-related expenses scheme (in Dutch: werkkostenregeling), if a mobile phone is required in the performance of the employee’s duties and the ownership of the device rests with the employer. For instance managers who need to be contacted by phone after office hours or doctors who are on call.
This agreement can be used for a smartphone or any other telephone model. Please note: a separate user agreement laptop is also available in both English and Dutch.
